What is interment by remand?

In the 26 Counties of Ireland a person can be convicted in the court or remanded in custody for lengthy periods up to 2 yrs on alleged political actions on the opinion of Garda Chief Superintendent and no other evidence, it allows the word of a Garda Chief Superintendent or higher officer to be accepted as evidence of membership of an illegal organisation under the 1998 Offences Against the State Act. This cannot be challenged by the defense as the state them claim that revealing the evidence would endanger it source.

Internment by remand is politically motivated internment of Irish Republicans by 26 County forces; they are interned on bogus membership charges. Their 'crime? opposition to the British inspired Belfast agreement.
That the 26 County establishment can intern members of legal political movements without any shred of evidence has barely been mentioned by those liberal minded elected representatives in Ireland nor has there been an outcry from those former Republicans who have signed up to administer British Rule in occupied Ireland when these actions were used against them

These same people are silent at the recent use of these laws perhaps because it removes political opponents of the GFA.


The abuse of power shown by these cases has never been challenged by so called human rights organisations, the blatant breach of civil liberties and human rights by the state and the blind eye turned by these so called human rights groups can only lead to the conclusion they are silent because they support  the use of these methods to remove political opponents from the streets and imprison them on the word of a Garda superintendent.


There is no doubt that these actions are as a result of collusion between the 26 County Government and the security services of the British, MI5 and those administering British control in the Stormont regime.
They are using the draconian laws available in the 26 Counties to remove Irish Republican activists knowing they have the corrupt legal system to jail opponents for up to 6 years, without having to produce the slightest shred of evidence other than a Garda superintendent who's evidence cannot be challenged by the defense.

 This is an issue which covers all shades of Irish Republicans who have refused to accept the failed GFA and who cannot be bought or threatened to sell their Republican ideals.

There must be unity among all shades of Irish Republicanism to challenge this action of removing those that the state views as a threat and to attempt to neutralise political opposition.

Reasons Noel should be repatriated:

• He is an Irish citizen and holds a valid Irish Passport, issued in  Dublin

• He easily qualifies for repatriation under the European directive,
which allows prisoners to be moved back to their   own country to serve their sentence closer to their family for purely humanitarian reasons.

•  He has not seen his children in 6 Years.

• There was an attempt to murder Noel last year in which he received serious knife wounds. If left alone and isolated his life would be constantly under threat!

 • His physical and mental well being is in jeopardy if the Irish
Government refuses him the right to be brought   home to serve his sentence in an Irish Jail

Irish Political Prisoner Noel Maguire

Below is the letter sent to Dermot Ahern by Noel Maguire asking how Ahern could come to the conclusions he has from the material available to him.

 

We are asking everyone to contact Dermot Ahern and express disgust at his inhumane attitude toward Noel Maguire.

 

Also ask if Noels Irish citizenship

has been revoked and any rights as a valid passport holder have been stripped from him. And if so why?.

 

All right minded people should throw their weight behind a campaign of letter writing and lobbying of those that are standing in the way of allowing Noel

Maguire home.

 

Over the past number of months we have heard a lot of talk about Republican Unity and the things that unite Republicans, The POW issue is one of those

issues that all sincere Republicans should put aside their differences and support all the prisoners, Noel Maguire needs all our help if we can get enough letters

and inquiries going perhaps then those unfeeling, uncaring faces behind the opposition to allowing an Irish citizen his right to serve the rest of his sentence

in the same country as his family resides and the country he calls home will realize that they are wrong and do the right thing.

NOELS LETTER;

 

 

Dear Mr Ahern

 

Thank you for your letter dated October 23 in reply to my application for repatriation.

 

I am aware the Council of Europe Convention on the Transfer of Sentenced Prisoners does not confer an automatic right to be transferred - nor an obligation on any state to comply with a transfer request.

 

However what concerns me is the reason you have given to refuse my application.

 

You state that on balance you believe I have closer ties to the United Kingdom than

to an Irish jurisdiction. I would dispute this. How can that be?

 

I have a wife, and a son and daughter, living in County Carlow in the Irish republic. They are my immediate kith and kin. Although my wife and I are separated she has put in writing she is willing to visit me should I be repatriated to Portlaoise Prison. A copy of her letter is in your possession as I write this. If it has been mislaid I can forward a copy.

 

I have not seen my son and daughter for over nine years. My wife - rightly - isn't happy to bring them over to this country and put them through the ordeal of visiting me in prison - not to mention the cost involved traveling and staying overnight in another country.

 

I have no family in Britain and my sole visitor is a non-relative.

 

Can you please explain why my wife, son and daughter are not considered to be my next of kin?

 

Also can you explain how you reached the conclusion I have closer ties to the United Kingdom than to an Irish jurisdiction - bearing in mind

I have no relatives living in the UK whatsoever - and am the bearer of an Irish republic passport which is still valid.

Political Prisoners

 l am a political prisoner. I am a political prisoner because l am a casualty of a perennial war that is being fought between the oppressed Irish people and an alien, oppressive, unwanted regime that refuses to withdraw from our land.

I believe and stand by the God-given right of the Irish nation to sovereign independence, and the right of any Irishman or woman to assert this    right in armed revolution. That is why lam incarcerated, naked, and tortured.

I am dying not just to attempt to end the barbarity of H-Block, or to gain the rightful recognition of a political prisoner, but primarily because what is lost in here is lost for the Republic and those wretched oppressed whom I am deeply proud to know as the “risen people.”
